1. Our Terms of Use

  • 1.1 By using and visiting the website you agree to our terms of use, and our associated privacy policy, which shall take effect immediately when you first visit www.mbwales.com. If you do not agree to these terms of use or our privacy policy then please do not access or use the website. Welsh Assembly Government may well change these terms at any time by posting changes online. Your continued use of the website after any changes have been posted means that you agree to be legally bound by the updated terms of use.
  • 1.2 By using the website you confirm that you are over 18 years of age or you possess the consent of a legal guardian or parent.
  • 1.3 We reserve the right at any time and from time to time in our sole discretion and with or without notice to modify or discontinue, temporarily or permanently, the website (or any part thereof) or your individual use of the website. You agree that we shall not be liable to you or to any third party for any such modification, suspension or discontinuance of the website.
  • 1.4 In no event shall we be liable for any damages whatsoever arising from your use of the website including damages for loss of data, loss of profits or loss connected with the use or performance of the website or for the delay or inability to use the website or for information products or services obtained through the website, except that nothing under the User Terms shall limit our liability for any fraudulent statement or for personal injury or death caused by our negligence.

2. Access

  • 2.1 You agree to use the website only for lawful purposes, for personal and non-commercial use only and you agree not to copy or distribute any part of the website without Welsh Assembly Government's prior written permission.
  • 2.2 You agree that your use of the website shall be at your sole risk. Welsh Assembly Government and it's employees make no warranties for the accuracy or completeness of the website's content and assume no responsibility for any negative outcomes in association with the use of the website.
  • 2.3 You agree not to use any automated system that accesses the website in a manner that creates more requests for information or uploaded information that can be reasonably produced via a conventional web browser.

3. Intellectual Property Rights

  • 3.1 We own all copyright in all features of the website (including, without limitation, the design of the web site, all logos, text and graphics on the web site), except such user generated content as outlined below.
  • 3.2 When you upload content to the website, you assign to Welsh Assembly Government non-exclusive licence to use your videos, pictures and descriptive text on the MBWales web site and in any other communications. You agree that Welsh Assembly Government can modify this information and make editorial revisions.

4. User generated content

  • 4.1 The publishing of any content submitted by the user is at the discretion of Welsh Assembly Government and Welsh Assembly Government expressly reserve the rights to restrict the publishing of any material for whatever reason. The conditions relating the submission of user generated content are subject to the terms of use outlined here and further guidance for the user is available on the website.
  • 4.2 The user shall be solely responsible for the consequences of uploading and publishing content on the website. Under no circumstances will Welsh Assembly Government be responsible for any loss or damages resulting from the publishing of user generated content on this website.
  • 4.3 You agree that you will not 1) submit any material which is not your own or you do not own the copyright for or that you have not got permission from the originator 2) upload falsehoods or misrepresentations that could damage Visitwales or any third party 3) submit any material that is unlawful, obscene, pornographic, offensive or otherwise inappropriate 4) solicit for business 5) impersonate another person
  • 4.4 If you are a copyright owner and you believe any user generated content on the site infringes upon your copyright or you believe that any user generated content is inappropriate for any reason you can notify Welsh Assembly Government - contact details below.
  • 4.5 Where user generated content relates to access to the countryside (e.g. routes and trails in relation to walking and cycling) it must only provide information on areas, routes and trails that are part of the public Rights or way network or are open to general public use. Content must not include any information, words or pictures that constitutes any legal activity or contravenes any relevant byelaws.
  • 4.6 You agree not to include the name of any specific businesses within the text based content uploaded to the site.

5. Bike Prize Draw

  • 5.1 Entrants must not be employees (or members of their families) of the Visit Wales or Welsh Assembly Government, or anyone connected with the draw.
  • 5.2 The draw for the mountain bike will be made twice a year at the end of March and the end of September. Visit Wales will allocate the individual prize to the winner.
  • 5.3 Only on completion of all fields of the electronic registration form on www.mbwales.com will the individual gain entry into the bike draw.
  • 5.4 Only one registration per household allowed.
  • 5.5 Entry to the prize draw is free. No purchase necessary.
  • 5.6 The winner will be notified by post. The name of the prize winner will be made available after the the draw to anyone sending a self addressed envelope to MBWales.com, Visit Wales, Brunel House, 2 Fitzalan Road, Cardiff, CF24 OUY, in an envelope marked ‘Mountain Bike Draw’
  • 5.7 Prize is non-transferable. No cash alternative will be offered.
  • 5.8 An independent person will make the draw.
  • 5.9 Winner agrees to use his/her name and photograph in future publicity. Judges decision is final.

6. Indemnity

  • 6.1 You hereby agree fully to indemnify, keep indemnified and hold us or any of our officers, employees, agents, sub-contractors and affiliated companies harmless from and against any and all costs, claims, losses, damages or liability and expenses (including, but not limited to, legal fees) made by any third party in any jurisdiction due to or arising out of your use of the website, your connection to the website, your breach of the terms of use or any other breach by you of any third party rights.

7. Disclaimers and Warranties

  • 7.1 You expressly understand and agree that your use of the website is at your own risk. The website is provided on an 'as is' and 'as available' basis. We expressly make no warranties of any kind as to the website, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
  • 7.2 In particular, we make no warranty that (i) the website will meet your requirements, (ii) the website will be uninterrupted, timely, secure or error-free, (iii) the results that may be obtained from your use of the website will be accurate or reliable, (iv) the quality of any products, services, information, or other material obtained by you through the website will meet your expectations, (v) any errors in the Software will be corrected and (vi) the website is virus free or the website contains anything which may have destructive properties.
  • 7.3 Any content downloaded or otherwise obtained through the use of the Service is done so at your own discretion and risk and you understand and agree that you will be solely responsible for any damage to your computer system or loss of data that results from the download by you of any such content.
